How can a traffic stop reach your safety record?
Through the roadside inspection report. FMCSA uses violations recorded on a roadside inspection report in its Safety Measurement System (SMS) whether the officer also writes a citation or gives only a verbal warning. A state citation issued without an inspection report is not used.
Once recorded, a violation counts in your Unsafe Driving BASIC for 24 months. It carries three times its severity weight for the first six months, twice for the next six, and its face weight after that. FMCSA flags general carriers for possible intervention at the 65th percentile in this category, compared with the 80th percentile for categories such as Vehicle Maintenance and Driver Fitness.

What happens to the driver's CDL?
A citation that ends in a conviction follows the driver. Under 49 CFR 383.31, a CDL holder convicted of any traffic violation other than parking, in any vehicle, must notify the current employer in writing within 30 days.
Several of the most common Safe Driver Week infractions are serious traffic violations under 49 CFR 383.51: speeding 15 mph or more over the limit, reckless driving, improper lane changes, following too closely, texting, and hand-held phone use. A second conviction within three years while driving a commercial vehicle disqualifies the driver for 60 days. A third disqualifies for 120 days.
How to keep Safe Driver Week off your record
The behaviors officers look for that week are illegal all year. Each step below turns one of them into a company control.
Step 1: Put the carrier prohibitions in writing
Federal rules bar carriers, not only drivers, from allowing texting or hand-held phone use while driving, driving without a seat belt, and radar detectors in the truck. Write each into your driver policy and have every driver sign it.
Step 2: Check dispatch against speed limits
Under 49 CFR 392.6, a carrier may not schedule a run that can only be made by speeding. Build delivery windows from legal speeds, and treat a driver who keeps arriving early as a question, not a compliment.
Step 3: Log conviction notices
Remind CDL drivers of their 30-day duty to report convictions, and log each notice so you can see a second serious violation coming.
Step 4: Review driving records every year
Pull each driver's motor vehicle record at least every 12 months and give great weight to speeding and reckless driving, as 49 CFR 391.25 requires. Keep the record and a note of the review in the driver qualification file.
Step 5: Read every inspection report
